DMCA & Copyright Policy

This DMCA & Copyright Policy (“Policy”) describes how PostGrid, Inc., together with its affiliates and subsidiaries worldwide (collectively, “PostGrid,” “we,” “us,” or “our”), responds to allegations of copyright infringement relating to the Services.

This Policy applies globally. Where applicable, it is intended to comply with the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512) (“DMCA”) and other applicable intellectual property laws.

This Policy does not modify any agreement between PostGrid and its customers, including the applicable Master Services Agreement, Terms of Service, or Order Form (the “Underlying Agreement”).

1. Scope

This Policy applies to alleged copyright infringement involving content, data, templates, designs, documents, images, or other materials submitted to, processed through, or distributed via the Services by Customers or their authorized users.

PostGrid does not operate a public content-sharing or social publishing platform. Customers are solely responsible for ensuring that all materials they upload, process, or distribute through the Services do not infringe third-party intellectual property rights.

2. Submitting a DMCA Notice

If you believe that material processed or distributed through the Services infringes your copyright, you may submit a written notice including the following information:

  • Identification of the copyrighted work claimed to have been infringed;
  • Identification of the allegedly infringing material and sufficient information for us to locate it;
  • Your name, mailing address, email address, and telephone number;
  • A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or applicable law;
  • A statement that the information provided is accurate and, where required by applicable law, that you are authorized to act on behalf of the copyright owner; and
  • A physical or electronic signature.

Where the claim arises under U.S. law, notices should comply with the requirements of 17 U.S.C. § 512(c)(3).

3. Response to Notices

Upon receipt of a notice that substantially complies with applicable legal requirements, PostGrid may, in its discretion and as required by applicable law:

  • Remove or restrict access to the allegedly infringing material;
  • Notify the affected Customer;
  • Request additional information from either party; and/or
  • Take action under the Acceptable Use Policy or Underlying Agreement, including suspension or termination in cases of repeat or material infringement.

PostGrid reserves the right to decline to act on notices that are incomplete, abusive, or legally deficient.

4. Counter-Notifications

If a Customer believes that material was removed or restricted due to mistake or misidentification, the Customer may submit a counter-notification.

For claims governed by U.S. law, counter-notifications must comply with 17 U.S.C. § 512(g) and include:

  • Identification of the material removed or restricted;
  • A statement under penalty of perjury that the removal was due to mistake or misidentification;
  • Contact information;
  • Consent to jurisdiction of the appropriate court (where required by applicable law); and
  • A physical or electronic signature.

PostGrid may forward valid counter-notifications to the original complainant and may restore access to the material as permitted by applicable law.

5. Repeat Infringement Policy

PostGrid maintains a policy of terminating or suspending accounts of Customers who repeatedly or materially infringe intellectual property rights, in accordance with the Acceptable Use Policy and the Underlying Agreement.

6. No Public Adjudication

PostGrid does not adjudicate ownership disputes. Where competing claims arise, PostGrid may require a court order or other legally binding determination before restoring or permanently removing material.

7. No limitations

Nothing in this Policy limits PostGrid’s right to:

  • Enforce its contractual rights;
  • Pursue other remedies available under law; or
  • Comply with legal obligations in any jurisdiction.

8. Changes to This Policy

PostGrid may update this Policy from time to time to reflect changes in law, Services, or operational practices. Updates will be posted on the Legal Page and will be effective as of the date posted.

Continued use of the Services after the effective date constitutes acceptance of the revised Policy.
